    Terms and Conditions 

    These terms and conditions (the "Terms and Conditions") govern the use of torontohousing.ca (the "Site"). This Site is owned and operated by Toronto Community Housing Corporation (TCHC). This Site is a place for TCHC to communicate with tenants and other stakeholders. 
     
    By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times. If you do not agree with any of the Terms and Conditions, do not use this site. 

    Intellectual Property 

    All content published and made available on our Site is the property of Toronto Community Housing Corporation and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site. 

    Accuracy of Data and Information Disclaimer 

    TCHC has taken measures to provide up to date and accurate information and data. Errors, inaccuracies or omissions may sometimes occur. All information and data is provided "as is" and "as available" with no guarantee, representations or warranties to completeness, accuracy, timeliness, or of the results obtained from the use of this information. 

    Warranty Disclaimer 

    TCHC SPECIFICALLY MAKES NO WARRANTY EXPRESSED OR IMPLIED REGARDING ACCURACY, ADEQUACY, COMPLETENESS, LEGALITY, RELIABILITY OR USEFULNESS OF ANY INFORMATION OR DATA. TCHC is providing links to the Third Party Sites to you only as a convenience, and the inclusion of any link does not imply an endorsement by TCHC of the Third Party Site or its owner. Be advised that when you click through to a Third Party Site that TCHC's Privacy Policy and privacy practices do not apply to that site. It is your responsibility to examine the privacy statements for all Third Party Sites and understand their procedures for collecting, using, and disclosing your information. 

    Viruses 

    While effort is made to ensure that all information provided on the site does not contain computer viruses, you are responsible to take reasonable and appropriate precautions to scan for computer viruses and ensure that you have a complete and current backup of the applicable items of information contained on your computer system. 

    Acceptable Use 

    As a user of our Site, you agree to use our Site in compliance with applicable laws, and not to: 

    Use the Site to harass or mistreat other users of our Site; 

    Violate the rights of other users of our Site; 

    Violate the intellectual property rights of the Site owners or any third party to the Site; 

    Hack into the account of another user of the Site;

    If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site. 

    Limitation of Liability and Waiver 

    TORONTO COMMUNITY HOUSING CORPORATION AND OUR SHAREHOLDER, DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, SUBSIDIARIES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY ACTIONS, CLAIMS, LOSSES, DAMAGES, LIABILITIES AND EXPENSES INCLUDING LEGAL FEES ("CLAIMS") RELATED IN ANY WAY FROM YOUR USE OF THE SITE OR ITS CONTENT. YOU HEREBY WAIVE AND RELEASE TORONTO COMMUNITY HOUSING CORPORATION AND OUR DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, SUBSIDIARIES, AND AFFILIATES FROM ANY AND ALL SUCH CLAIMS THAT MAY ARISE FROM YOUR USE OF THE SITE OR ITS CONTENT.   

    Indemnity 

    Except where prohibited by law, by using this Site you indemnify and hold harmless Toronto Community Housing Corporation and our shareholder, directors, officers, agents, employees, subsidiaries, and affiliates from any Claims arising out of your use of our Site or your violation of these Terms and Conditions. 

    Applicable Law 

    These Terms and Conditions are governed by the laws of the Province of Ontario, Canada. 

    Severability 

    If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid. 

    Changes 

    These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users of changes to these Terms and Conditions by posting a notice on our Site.

    Privacy Policy 

    Toronto Community Housing is committed to protecting the privacy of any personal information you may provide when visiting our Site. Part of that commitment is to explain what information may be collected and why, how it will be used and who may have access to it. Our practices have been designed to ensure compliance with the privacy provisions of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA). This privacy statement applies to interactions with Toronto Community Housing Corporation's Site. It does not apply to any other Site. 

    Personal information 

    When you visit the TCHC Site, you do so anonymously - there is no need to tell us who you are. If you direct an enquiry to a specific TCHC department, we may ask you to provide your name and mailing address or e-mail address for the purpose of responding to your enquiry. Only those who "need to know" will have access to the personal information provided. 

    TCHC does not intend to use any information provided by visitors for any purpose that is inconsistent with the purpose for which the information was provided, as stated on the web page. A visitor to the TCHC Site will not receive correspondence or e-mails from the Corporation on any subject other than those subjects the visitor has given us permission to contact them about. 

    Logging practices 

    TCHC logs HTTP requests to the TCHC Site. These logs record the IP address of Site visitors. An IP address is the number automatically assigned to the computer or to the ISP (Internet Service Provider) requesting a URL. Log files are archived and used for systems analysis, maintenance and site evaluation. 

    Use of cookies 

    During user interaction with our Site, we may use a browser feature called a "cookie" to store information anonymously. A cookie is a small text file containing a unique identification number that identifies your browser - but not you - to our computers each time you visit our Site. 

    Unless you specifically advise us, we will not know who you are, even though we may assign your computer a cookie. We cannot use cookies, by themselves, to disclose the individual identity of any Site user, and we never combine information gathered by a cookie with personally identifiable information, such as your name, telephone number, or your e-mail address. 

    Collection and use of personal information 

    TCHC tenants have the right to know how and for what their personal information is being used. 

    Toronto Community Housing has developed a Notice of Collection, Use and Disclosure of Personal Information which outlines how tenants' personal information will be collected, used and disclosed. 

    What is the notice about? 

    The notice specifies the type of personal information that is collected, how we obtain the information, and provides an overview of what the personal information is used for.

    Privacy Policy FAQs

    What is the Privacy Policy?

    Toronto Community Housing Corporation is committed to protecting the Personal Information and privacy of its tenants. The Privacy Policy highlights our obligations to protect personal information that is collected, used, disclosed and disposed of by Toronto Community Housing. The policy was approved in February 2018.

    Why was the Privacy Policy created?

    The Privacy Policy was created to outline Toronto Community Housing’s obligations to protect personal information. It is based on principles in the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), Personal Information Protection and Electronic Documents Act (PIPEDA) and the Housing Services Act (HSA).

    Who must follow this policy?

    This policy applies to all Toronto Community Housing employees, board members, contract management companies and vendors.

    What are Toronto Community Housing’s responsibilities under the Privacy Policy?

    Under the Privacy Policy, Toronto Community Housing must: 

    • Promote a culture and business practices where information is accessible, while respecting the security and privacy of personal information 
    • Educate employees who are responsible for protecting personal information 
    • Follow procedures when disclosing personal information to law enforcement agencies in Canada 
    • Investigate and respond to complaints about the collection, use and disclosure of personal information

    What kind of information does Toronto Community Housing collect about its tenants?

    Toronto Community Housing collects personal information when a household applies to become a tenant of Toronto Community Housing and throughout the duration of the tenancy. Toronto Community Housing may also collect the address, contact information and financial information of former tenants who owe money related to their former tenancy.     What are obligations of employees under the Privacy Policy?

    All Toronto Community Housing employees must follow the Privacy Policy when collecting, using or disclosing personal information. Employees must take the necessary steps to protect personal information that is under their care, including safeguarding documents, tenant files, laptops, cell phones and company files, and when using computer systems and sending e-mail.

    Can employees access information that is not associated with their work?

    Toronto Community Housing employees are not allowed to use, access or disclose personal information that is not related to their work.

    What happens if employees do not follow this policy?

    Employees who do not follow this policy or the related sections outlined in the Code of Conduct may be subject to discipline up to and including termination for cause.

    How will Toronto Community Housing collect, use and disclose personal information?

    Toronto Community Housing collects uses and discloses personal information of its tenants, employees, directors and vendors to the extent necessary to perform its work while being in accordance and compliance with legislation and Toronto Community Housing policies.

    How long will Toronto Community Housing retain collected information?

    Personal information will be retained for the duration of its purpose. Once the purpose is completed, the personal information will be disposed of in accordance with Toronto Community Housing’s records retention schedule.

    Can Toronto Community Housing collect or use personal information without consent?

    Yes, Toronto Community Housing may collect, use and disclose personal information without consent if it is allowed by legislation.

    Can I access a record that is in the custody of Toronto Community Housing?

    Every person has the right of access to a record or parts of a record under the custody or control of Toronto Community Housing, unless the record or part of the record falls within one of the exemptions under MFIPPA.

    How can I access records that are in the custody of Toronto Community Housing?

    You can request access to a record by filling out an MFIPPA request form (PDF) and sending it to the Information Specialist, Toronto Community Housing Corporation, 931 Yonge St., 6th Fl., Toronto, Ontario M4W 2H2. Use the form to request access to a general record or personal information record, or to request a correction to a personal information record in the custody of Toronto Community Housing.

    What happens if there is a privacy breach?

    If a privacy breach should occur, Toronto Community Housing will take measures to stop the privacy breach and prevent future incidents. This includes containing the privacy breach, notifying affected individuals and the Information and Privacy Commissioner of Ontario, and conducting an internal investigation.
